George H.W. Bush out of intensive care, on the mend

Former President George H.W. Bush has been moved from the intensive care unit to a regular room in Methodist Hospital in Houston, Texas. Bush, who is 88, was admitted for respiratory problems following a bought of bronchitis.

Bush, 88, who served as president from 1989 to 1993, entered?Methodist Hospital?on Nov. 23 for treatment of what doctors said was bronchitis, and he was moved into the ICU last Sunday after suffering a number of medical complications, including a persistent fever.

Bronchitis is an inflammation of the mucous membranes lining the air passages through the lungs.

"President?Bush's condition has improved, so he has been moved today from the intensive care unit to a regular patient room at the?Methodist Hospital?to continue his recovery," the family said in a statement from his spokesman,?Jim McGrath.

"The Bushes thank everyone for their prayers and good wishes," it added.

McGrath said on Friday that?Bush's condition was getting better and that he was even singing at times in his communications with doctors and nurses.

He added in an email reply to Reuters on Saturday, "George?Bush?is the most relentlessly upbeat man you'll ever meet, and his spirits have been good throughout this ordeal." He declined to disclose any information aboutBush's prognosis or how much longer he might remain hospitalized.

Bush, the 41st U.S. president and a Republican, is the father of former President?George?W.?Bush. In a political career spanning four decades, he also served as a congressman, ambassador to the?United Nations, envoy toChina, CIA director, and vice president for two terms under Ronald Reagan.

Bush?has lower-body parkinsonism, which causes a loss of balance, and has used a wheelchair for more than a year.

Melvin Guillard survives Jamie Varner slam but loses UFC 155 bout

Melvin Guillard and Jamie Varner staked a late claim to the UFC 155 Fight of the Night bonus with a bout that ended in a split decision. Varner won it on the judges' cards, 30-27, 27-30, 29-28.

Varner gained an edge early in the bout by tagging Guillard in the first round. Guillard showed good kicks, but couldn't escape Varner's takedowns for much of the bout. But the most frightening moment of the bout came late in the third round.

The two were scrambling on the ground for position when Guillard took Varner's back. Varner stood up, and with Guillard's head pointed to the ground, Varner slammed his opponent to the ground. Amazingly, Guillard was not knocked out or injured from the move. The fight ended seconds after, and the two embraced.

?This was a very emotional fight for both of us," Varner said after the bout. "After what happened a few weeks ago at the "TUF Finale" event, we were both ready to compete. I knew we would eventually get in the Octagon and squash our beef and I definitely feel that we did. I?m happy about my performance, I feel that I was able to dominate the fight wherever we ended up and I?m glad I got the win.?

Varner and Guillard were originally scheduled to fight during "The Ultimate Fighter" finale on Dec. 15, but illness kept Varner from the cage. Guillard was understandably upset about the delay, leading to trash talk.

Toshiba preps 20megapixel, backsidelit CMOS sensor for pointandshoot cameras

When smartphones are encroaching on compact cameras' turf, how does a company try to stay relevant making sensors for those cameras? By upping the resolution, of course. Toshiba has given a peek at the TCM5115CL, a 1/2.3-inch, backside-illuminated CMOS sensor that hits 20 megapixels -- a big jump from the 16-megapixel sensors in many point-and-shoots and some smartphones. To combat the noise and sensitivity problems that usually come with a denser design, the electronics giant is using pixels that can absorb 15 percent more of a charge, and therefore more light. Toshiba has primed the sensor for high-speed shooting and video as well, with the potential for 1080p video at 60FPS and 30FPS burst shooting at full resolution, provided the processor can keep up. Police offer 'virtual ridealongs' via Twitter

SIOUX FALLS, S.D. (AP) ? Riding side by side as a police officer answers a call for help or investigates a brutal crime during a ridealong gives citizens an up close look at the gritty and sometimes dangerous situations officers can experience on the job.

But a new social media approach to informing the public about what officers do is taking hold at police departments across the United States and Canada ? one that is far less dangerous for citizens but, police say, just as informative.

With virtual ridealongs on Twitter, or tweetalongs, curious citizens just need a computer or smartphone for a glimpse into law enforcement officers' daily routines.

Tweetalongs typically are scheduled for a set number of hours, with an officer ? or a designated tweeter like the department's public information officer ? posting regular updates to Twitter about what they see and do while on duty. The tweets, which also include photos and links to videos of the officers, can encompass an array of activities ? everything from an officer responding to a homicide to a noise complaint.

Police departments say virtual ridealongs reach more people at once and add transparency to the job.

"People spend hard-earned money on taxes to allow the government to provide services. That's police, fire, water, streets, the whole works, and there should be a way for those government agencies to let the public know what they're getting for their money," said Chief Steve Allender of the Rapid City Police Department in South Dakota, which started offering tweetalongs several months ago ? https://twitter.com/rcpdtweetalong ? after watching departments in Seattle, Kansas City, Mo., and Las Vegas do so.

On the day before Thanksgiving, Tarah Heupel, the Rapid City Police Department's public information officer, rode alongside Street Crimes Officer Ron Terviel. Heupel posted regular updates every few minutes about what Terviel was doing, including the officer citing a woman for public intoxication, responding to a call of three teenagers attempting to steal cough syrup and body spray from a store and locating a man who ran from the scene of an accident. Photos were included in some of the tweets.

Michael Taddesse, a 34-year-old university career specialist in Arlington, Texas, has done several ridealongs with police and regularly follows multiple departments that conduct tweetalongs.

"I think the only way to effectively combat crime is to have a community that is engaged and understands what's going on," he said.

Ridealongs where "you're out in the elements" are very different than sitting behind a computer during a tweetalong and the level of danger is "dramatically decreased," he said. But in both instances, the passenger gains new information about the call, what laws may or may not have been broken and what transpires, he added.

For police departments, tweetalongs are just one more way to connect directly with a community through social media.

More than 92 percent of police departments use social media, according to a survey of 600 agencies in 48 states conducted by the International Association of Chiefs of Police's Center for Social Media. And Nancy Kolb, senior program manager for IACP, called tweetalongs a "growing trend" among departments of all sizes.

There is no set protocol and departments are free to conduct the tweetalong how they see fit, she said.

In Ontario, Canada, the Niagara Regional Police Service conducted their first virtual ridealong in August over a busy eight-hour Friday night shift. The police department's followers were able to see a tweet whenever the police unit was dispatched to one of the more than 140,000 calls received that night.

Richard Gadreau, the social media officer for the police department, said officers routinely take people out on real ridealongs, but there is a waiting list and preference is given to people interested in becoming an officer.

With tweetalongs, many calls also mean many tweets. Kolb said departments are cognizant of cluttering peoples' Twitter feeds.

That's why the Rapid City Police Department decided to create a separate account for the tweetalong, Allender said.

Kolb also said officers are careful not to tweet personal or sensitive information. Officers typically do not tweet child abuse or domestic abuse cases, and they usually only tweet about a call after they leave the scene to protect officers and callers.

But Allender, the chief of police in Rapid City, said tweetalongs also show some of the more outrageous calls police deal with on a regular basis ? like the kid who breaks out the window of a police car while the officer is standing on the sidewalk.

"Real life is funnier than any comedy show out there and not to make fun of people, embarrass them or humiliate them, but people do funny things," Allender said. "... I mean, that guy deserves a little bit of ridicule, and everyone who would be watching would agree. That's just good clean fun to me."

Cliff looms: Kicking the Can, Washington-style

WASHINGTON (AP) ? When it comes to the nation's budget challenges, congressional leaders are fond of saying dismissively they don't want to kick the can down the road.

But now, a deadline hard ahead, even derided half-measures are uncertain as President Barack Obama and lawmakers struggle to avert across-the-board tax increases and spending cuts that comprise an economy-threatening fiscal cliff.

Congressional officials said Wednesday they knew of no significant strides toward a compromise over a long Christmas weekend, and no negotiations have been set.

The Senate is due in session Thursday, although the immediate agenda includes legislation setting the rules for government surveillance of suspected spies and terrorists abroad, including Americans, as well as a measure providing $60 billion for victims of Superstorm Sandy.

Obama decided to cut short his Hawaii vacation for an overnight flight expected to get him back to the White House in the pre-dawn hours of Thursday.

After weeks of negotiations, the president urged lawmakers late last week to scale back their ambitions and send him legislation preventing tax cuts on all but the highest-earning Americans and extending unemployment benefits for the long-term jobless. Longer, term, he said he still supports deficit cuts that were key to the earlier talks.

"Everybody's got to give a little bit in a sensible way," he said at the White House.

The House has no plans to convene, following last week's rebellion in which conservatives torpedoed Speaker John Boehner's legislation to prevent scheduled tax increases on most, while letting them take effect on million-dollar wage earners.

"How we get there, God only knows," the Ohio Republican said of efforts to protect the economy ? and taxpayers ? from the tax increases and spending cuts.

"Now is the time to show leadership, not kick the can down the road," Senate Majority Leader Harry Reid, D-Nev., said a little over a week ago after Boehner announced he would shift his own focus from bipartisan talks to the approach that eventually was torpedoed by his own rank and file.

It's a phrase that political leaders use when they want to suggest others want to avoid tackling major problems, and one that Boehner, House Majority Leader Eric Cantor of Virginia and even Obama as well as Reid have used.

"We have a spending problem. We have to address it, And we're not going to address it by kicking the can down the road," the speaker said at a news conference late last week when he was asked about setting a vote on a plan that Democrats find acceptable.

Cantor recently used the same approach in challenging Obama to agree to savings from Medicare and other benefit programs. "This has to be a part of this agreement or else we just continue to dig the hole deeper, asking folks to allow us to kick the can down the road further and that we don't want to do," he said on Nov. 28.

In fact, it's a phrase that has been in use for over a year as Obama and Republicans jockey for position on pocketbook issues.

In July, 2011, when he was struggling with Republicans over the threat of a first-ever government default, Obama said he had "heard reports that there may be some in Congress who want to do just enough to make sure that America avoids defaulting on our debt in the short term. But then wants to kick the can down the road when it comes to solving the larger problem, our deficit."

A few months later, an extension of a payroll tax cut was the issue, and Boehner was insisting on a year-long renewal rather than the temporary plan that passed the Senate with votes from lawmakers in both parties.

"How can you do tax policy for two months?" he asked on Dec. 18, 2011. "I believe that two months is just kicking the can down the road.

"The American people are tired of that."

At issue now is series of tax increases and spending cuts scheduled to kick in with the new year that economists caution could send the economy into a recession.

Obama wants to let higher rates apply to upper incomes, but when Boehner relented and tried to pass legislation setting the threshold at $1 million ? higher than Democrats want ? Republicans refused.

Less than two months ago, all sides expressed optimism about far more than dealing with the expiring tax cuts.

The plan then was also to forge a compromise that would also replace about $500 billion in spending cuts aimed at the Pentagon and a variety of domestic accounts with a series of targeted reductions.

8 dead after Christmas Day fires in Philippines

MANILA, Philippines (AP) ? Authorities in the Philippines say at least eight people are dead after two separate Christmas Day fires in the capital region. One of the blazes left about 1,500 people homeless when it razed their shantytown.

Arson investigator Rosendo Cabillan says a predawn fire Tuesday razed two apartment buildings in Quezon City, a Manila suburb. A veterinarian and six household members died after they were trapped inside.

Fire officer Noel Binwag says another blaze in suburban San Juan city hours earlier destroyed shanties of about 1,500 people.

Binwag says angry residents beat a man to death after accusing him of starting the fire.

He says two firemen also were injured when they were hit by rocks by some residents who grabbed their fire hoses to put out the blaze themselves.

Egypt to announce result of constitution vote on Tuesday

CAIRO (Reuters) - Egypt will announce on Tuesday the official results of a vote on its new constitution, the head of the elections committee told state media on Monday, a step which paves the way for the formation of a new parliament in about two months.

The creation of a new constitution is a vital step in Egypt's transition to democracy almost two years after the fall of military-backed strongman Hosni Mubarak.

But the opposition says the text, crafted mostly by President Mohamed Mursi's Islamist allies, fails to guarantee personal freedom and the rights of women and minorities. It says it will lead to more trouble in the most populous Arab nation.

Unofficial tallies from the Muslim Brotherhood - which catapulted Mursi into the presidency this year - indicated that 64 percent had approved the charter. An opposition tally had a similar result.

"The Supreme Elections Committee will announce on Tuesday at 7 P.M. (17:00 GMT) the results of the referendum on the new constitution," judge Samir Abu el-Matti told state radio and TV late on Monday.

Matti also said that the committee, which is led by judges, had spent the last two days investigating opposition and rights' groups accusations of voting fraud.

Mursi's critics said the vote, conducted in two stages in a process that ended on Saturday, had been marred by a litany of irregularities, and have demanded a full inquiry.

The opposition, a loose alliance of socialists, liberal-minded Muslims and Christians, have also noted that less than a third of those eligible turned out to vote, undermining the legitimacy of the new constitution.

ELECTION LOOMS

If the "yes" vote is confirmed, a parliamentary election will follow in about two months, setting the stage for Islamists to renew their battle with more secular-minded opponents.

Opposition politician Mohamed ElBaradei, a Nobel peace prize winner, urged Mursi to form an all-inclusive government together with the liberal camp in order to patch up divisions and steer Egypt out of trouble in a democratic way.

"I am ready to join hands with President Mursi on condition that he forms a national (unity) government and speaks as president for all Egyptians," he told the daily Al-Shorouk.

ElBaradei, the former head of the U.N. nuclear agency, said a new assembly should rewrite the draft - a call unlikely to be heeded by Mursi, who is keen to push it through quickly.

By forcing the pace on the constitution, Mursi risks squandering the opportunity to build consensus for the austerity measures desperately needed to kick-start a the ailing economy, economists say.

Highlighting investor concerns, Standard and Poor's cut Egypt's long-term credit rating and said another cut was possible if political turbulence worsened.

Responding to what it said were market rumors, the central bank said it was taking steps to safeguard bank deposits.

Some Egyptians say they have withdrawn their funds from banks out of concern that they will be frozen by authorities.

LEGISLATIVE POWERS

Under the new constitution, legislative powers that have been temporarily held by Mursi move to the Islamist-dominated upper house of parliament until a new lower house is elected.

The make-up of the Supreme Constitutional Court, which Islamists say is filled with Mubarak-era appointees bent on throwing up legal challenges to Mursi's rule, will also change as its membership is cut to 11 from 18.

Those expected to leave include Tahani al-Gebali, who has described Mursi as an "illegitimate president".

The low turnout in voting on the constitution has prompted some newspapers to question how much support the charter really had, with opponents saying Mursi lost the vote in much of the capital.

"The referendum battle has ended, and the war over the constitution's legitimacy has begun," said newspaper Al-Shorouk, while a headline in Al-Masry Al-Youm read: "Constitution of the minority".

The head of the Muslim Brotherhood's Freedom and Justice Party, Saad al-Katatni, wrote on Facebook that the group's members were "extending our hands to all political parties and all national forces", adding: "We will all start a new page."

But the opposition National Salvation Front say the new constitution only deepens a rift between the liberals and Islamists who combined to overthrow Mubarak, and that they will keep challenging it through protests and other democratic means.

"We do not consider this constitution legitimate," liberal politician Amr Hamzawy said on Sunday, arguing that it violated personal freedoms.

The run-up to the referendum was marred by protests triggered by Mursi's decision to award himself broad powers on November 22. At least ten people were killed in clashes in Cairo and violence also flared in Egypt's second city, Alexandria.

Expert Advice on Opening Your Own FranchiseFranchising is an appealing option for someone who wants to run a business without having to start it from the ground up. Restaurant franchises are probably the ones that people are?most familiar with. Franchises represent great opportunities for success, but those who want to buy a franchise have to be prepared for hard work and watch out for scams.

With the U.S. economy starting to recover after a long slump, franchising is picking up among people who want to run their own show while using a proven business concept. Business.com recently spoke with Bill Bradley of America?s Best Franchises about what?s going on in the world of franchising today.

Q. First of all, can you give us an idea of the enormous range of franchising opportunities available today? What is the most unusual franchise opportunity you have found?

A. There are about 3,500 different franchise opportunities in approximately 40 franchise industries; that would include everything from automotive aftermarket franchises to children?s franchises to senior care opportunities, travel, home maintenance, and franchises that cater to women?s skill sets.? It seems there is a franchise for just about any service or product you can think of.? Personally, I cannot imagine buying a pet or dog waste removal franchise, though they exist.

Q. The Franchise Disclosure Document (FDD) is something that any potential franchise owner should understand thoroughly. How do you recommend potential franchisees approach the FDD and associated franchise regulations? Should they bring in a franchise lawyer for advice?

A. Getting up close and personal with the FDD is paramount to the decision-making process.? I have a venture capital background so I am familiar with the due diligence process. Much of what you find in the FDD is similar to what any venture capitalist would research when determining the value of an investment. In addition to learning everything you can about the executive team, pay particular attention to Item 3, Litigation, Items 5,6, and 7, which discuss the fees associated with the opportunity, franchisee and franchisor obligations. If the FDD includes an Item 19, carefully research the financial performance of current franchisees. Buying a franchise is a long-term commitment.? I would highly recommend you hire a franchise attorney in all phases of the process.

Q. Much has been reported in the media about unemployment rates for U.S. veterans. But many franchises are now offering incentives to veterans for opening franchises. Can you describe some of the franchising incentives being offered to our veterans today?

A. The Veterans Transition Franchise Initiative is known as ?VetFran.? VetFran was organized to honor those men and women who have served in the U.S. military. I believe there are about 250 member companies that participate in the VetFran program offering various discounts to veterans.?MAACO, for example, offers a 25% discount to the initial license fee for qualified veterans.? AAMCO offers all veterans an $8,000 discount on the purchase of an AAMCO franchise. CertaPro Painters franchise provides a 10% discount on the franchise fee to military veterans with an honorable discharge.

Q. Your website has a helpful section on the Dos and Don?ts of franchising. Can you share with us the most important steps a potential franchisee should take before committing to a franchise?

A. As with just about any decision or choice in life, you should not assume anything.? Learn what questions to ask and don?t be afraid to ask them.? Get the answer you are looking for.? Current franchisees will be your best source of reliable information.? You need to develop a list of questions regarding the franchise opportunity.? Ask a variety of franchisees in different locales, including communities that look and feel like your community, and do not back off.? Get the answers to your questions so you can make an informed decision about buying a franchise.

Completely helpless against FB ID-theft from stalker ex-GF - Straight ...

I never imagined that this would actually be possible, but holy fuck she's got me.

I broke up with my ex ("X" from now on) a few times over the last month but agreed to get back together for various reasons. I could write 10 pages on how truly fucked up she is, but I'll just briefly mention, she's got very deep and serious issues (and one's that up until recently I've been very sympathetic to). She's an only child raised by an insanely controlling, paranoid-delusional mom, in a locked-in gated house, and she's been abused as a child.

She was so horrible to me one night a few weeks ago that I tried to end it once and for all as we sat in her car in front of my apartment. Just as I was about to open the door, she it the gas. (And again at the red light when I tried to jump out). Finally the next light I escaped, she got out after me leaving the keys in the car, she broke down crying on the sidewalk at my feet, I couldn't get her to budge so I said finally that we would go somewhere together and talk, car got stolen with all her stuff... not wanting to abandon her after this I got back together with her, figuring I'd at least stay with her until she was in a stable place again regarding her lost car, IDs, laptop, iPhone, etc.

AND, I gave her my Samsung tablet so she'd at least have access to the internet in the days immediately following. It wasn't long before major fights continued and there was a period where I refused to take her calls or communicate with her.

One night about a week and a half ago I was online late at night and I got a strange message in gmail that my account recovery info was changed. Well the message wasn't strange (and I quickly responded to it and changed the gmail password) but what was strange was that the message immediately disappeared from my inbox without a trace (bot in "trash" either).

At some point I noticed my skype password was changed and I regained access to that. And FB was changed once or twice where I was able to get back in. BUT a couple of days ago, on the 21st, she called me while I was drinking in a bar with friends, and I foolishly answered it. She threatened me numerous times with how she's gonna ruin my life and I told her in no uncertain terms "I'm not interested in your threats. Do whatever you need to do".

While I was still in the bar she managed to get into my facebook account, remove all the email addresses associated with it, create a new fake email address to associate with it, and remove phone numbers and other security verification info.

When I got back to my friend's place that evening I tried to log in and couldn't. There was a verification procedure I could follow but in the end FB said I'd need to wait 24 hours before gaining access again and te page would be down in the meantime. I figured, OK I can deal with it further tomorrow when I'm sober.

But the following day she had already gotten back in and posted personal and fairly explicit photos on my profile. I tried again to verify my identity with FB and again they accepted it but said I'd need to wait 24 hours before logging in again. Five minutes later she was back in.

I went to the police and filed a report but the police officer (a nice guy who genuinely wanted to help) really had nothing to say about the cyber stuff. (There was other real-life stalking going on as well). I got home and she had posted even worse video.

At this point, when I tried to do the "forgot password" verification, I only had 2 choices: either reset my PW through the fake email address that she created, or I could choose 3 friends who would be sent a code, who I could then call, get the code to provide to FB, which again locked me out for 24 hours. She was back in the next minute. And this is what I did all night. I have wonderful friends who took it very seriously and immediately provided the codes, but at some point X thought to unfriend some of them. (probably coincidentally, not because of the verification process). In any case I would provide codes, page went down, she was back in the next minute, wash rinse repeat about 5 or 6 times.

At some point FB no longer offered this other procedure and it was only through the email that she controlled that one could verify their identity. Holy fuck! I was losing my mind.

At this point there's nothing you can do. Absolutely nothing. After clicking "forgot password" there's the option of reset through that one email address or you can click that you no longer have access to that account, at which point FB simply says "sorry, you need access to a registered email to gain access to your account", and there's a link to help menus and stuff. None of the help menus, or various reports will get you anywhere I've tried them all.

(shit, apparently she's back in my account now unfriending more of my friends who I'm in contact with).

Anyway, there is absolutely no mechanism at this point to regain control. None. This is simply unbelievable. There are no email addresses or phone numbers or ways to report this.

The Samsung had my email password saved and from that I guess she got into my other accounts. I had my deleted mail recovered yesterday and I saw everything she did. About 15 or 16 emails in all where she did every step. I called a lawyer who is on the case but there's nothing he can do to get any immediate action. He has sent a letter to the offices in Dublin and I think contacted the police, but she could very well have control of my account for weeks.

This is truly a nightmare.

Anyone know if what she did is actually illegal in Germany, and what if so how is it even punishable?
